Cllr Pawle declared a non-pecuniary interest in matters relating to Rothamsted Park as a District Councillor (Item 6.1).

 

Cllr Heritage declared a non-pecuniary interest in matters relating to Rothamsted Park as a District Councillor (Item 6.1).

 

Cllr Cousin declared a non-pecuniary interest in matters relating to Rothamsted Park as a District Councillor (Item 6.1).

 

Cllr Farmer declared a non-pecuniary interest in matters relating to Rothamsted Park as a District Councillor and as a member of the Rothamsted Park Management Committee, a Committee of St Albans District Council (Item 6.1).

 

Cllr Scriven declared a non-pecuniary interest in relation to Item 6.1 as a member of PARC.

 

Cllr Butterworth declared a non-pecuniary interest in matters relating to Rothamsted Park as a District Councillor and as Chair of the Rothamsted Park Management Committee, a Committee of St Albans District Council (Item 6.1).

Council considered a report by the Town Clerk.

 

Council RESOLVED to:

 

(i)           Note that it has considered the proposed acquisition of the freehold of Rothamsted Park for £1, with the exception of the new Leisure Centre, new Culture Centre, new Depot and car parks, from St Albans District Council.

(ii)          Note the due diligence carried out by the Task & Finish Group

(iii)        Note that the Council is being advised by Surrey Hills Solicitors LLP

(iv)        Note that it is proposed that the acquisition take place on, or shortly after 8 April 2021, so that from that date the Council will own and manage Rothamsted Park as an open space for the benefit of residents of Harpenden.

(v)          Approve the acquisition of Rothamsted Park, subject to the Town Clerk finalising the Sale Agreement and related agreements, being the Transfer, Pre-emption Deed, Overage Deed and Lease of the tennis courts and multi-use games area, and related documents, in consultation with the Task & Finish Group

(vi)        Authorise the Town Clerk to execute the Sale Agreement and related agreements and documents, in the case of a deed, by applying the Council’s Common Seal and otherwise, by signature, and where a second witness or signatory is required authorise the Mayor or Deputy Mayor to be the second witness or signatory.
